Large Animal Bylaw

THE CORPORATION OF THE TOWNSHIP OF PAPINEAU-CAMERON
 
BY-LAW 2009-16
 
BEING A BYLAW TO PROHIBIT THE BEING AT LARGE OR TRESPASSING OF “LARGE ANIMALS” WITHIN
ANY PART OF THE CORPORATION OF THE TOWNSHIP OF PAPINEAU-CAMERON.
WHEREAS the Municipal Act, Section 10(2)9, 2001, c 25, as amended provides that a single tier municipality may
pass by-laws respecting matters pertaining to animals;
AND WHEREAS the Council of the Corporation of the Township of Papineau-Cameron deems it expedient to pass
such a bylaw;
THEREFORE BE IT ENACTED by the Council of the Corporation of the Township of Papineau-Cameron as follows:
1.  This bylaw may be referred to as the “Large Animal Bylaw”
2.  DEFINITIONS
In this bylaw:
“Large Animal” means cattle, horse, pony, goat, sheep, swine, llama, alpaca, emu, ostrich or any other fur bearing
animal other than a dog or cat.
“Municipal Enforcement Officer” means the officers or employees of the Corporation of the Township of Papineau-
Cameron responsible for the Enforcement of this bylaw.
“Owner” of an animal means any person or group of persons, partnership or corporation owning, keeping or
harboring large animals.
“Provincial Offences Officer” means a Police Officer or a Municipal Enforcement Officer.
3.  GENERAL REGULATIONS
a)This bylaw applies to the entire geographic areal of the Corporation of the Township of Papineau-Cameron in the
District of Nipissing
b)No owner shall allow his large animals to be at large, or trespass on the private property of any other person or on
any municipal property or municipal road allowance within the boundaries of the Corporation of the Township of
Papineau-Cameron.
c)For the purposes of this bylaw, large animals shall be deemed to be at large or trespassing unless either;
i)The large animal is upon property of its owner; or
ii)The large animal is upon the property of a person other than its owner and the owner of that property has given
permission for it to be there; or
iii)The large animal is moving from one private property to another on a road or road allowance under the direct
supervision of its owner or his agent, who is present at the time.
4.  ENFORCEMENT
Any police officer, provincial offences officer or municipal enforcement officer of the Corporation of the Township of
Papineau-Cameron whose duties include the enforcement of this bylaw, is authorized to enforce this bylaw pursuant
to the provisions hereof, the Municipal Act, S.O. 2001, c. 25 as amended, or any successor thereof, and the Provincial
Offences Act, R. S. O. 1990, c. P. 33, or any successor thereof.
5.  OFFENCES
Any person who contravenes any provisions of this bylaw is guilty of an offence and on conviction is liable to a fine,
penalty or order as provided for in the Provincial Offences Act, R.S. O. 1990, c.P.33, as amended or any successor
thereof , or in the Municipal Act, 2001, S.O. c.25, as amended or any successor thereof.
6.  This bylaw supersedes all previous bylaws.
7.  This bylaw comes into force upon the passing thereof.
